1. Introduction

The Hexeli website, accessible at https://hexeli.com, is operated by OZALO, a single-shareholder simplified joint-stock company (SASU) registered under number 989 435 904 RCS Paris.

These Terms of Use set out the rules applicable to accessing the website, browsing it and using its features and services.

By accessing the website or using its services, the user acknowledges having read these terms and agrees to comply with them.

If the user does not accept these terms, they must stop using the website.

2. Relationship with the General Terms and Conditions of Sale

These Terms of Use govern the general use of Hexeli.com.

Any order placed on the website is also subject to the General Terms and Conditions of Sale, the Shipping Policy, the Return and Refund Policy and the Privacy Policy.

In the event of a conflict concerning an order, the General Terms and Conditions of Sale prevail over these Terms of Use.

3. Access to the website

Access to Hexeli.com is normally possible 24 hours a day, 7 days a week, subject to maintenance operations, updates, technical incidents or events beyond Hexeli's control.

Hexeli may temporarily suspend all or part of the website where necessary for its operation, security or maintenance.

The user must have compatible equipment, an internet connection and software enabling them to access the website.

Costs relating to internet access remain the responsibility of the user.

4. Permitted use

The user agrees to use the website in accordance with these terms and with applicable laws and regulations.

In particular, it is prohibited to:

Hexeli specializes in the sale of LED lighting solutions, in particular hexagonal LED lighting systems intended for garages, workshops, detailing centers, showrooms, retail spaces, as well as professional and residential spaces.

Products may be offered in various formats, dimensions, power ratings and configurations. Hexeli may also sell the accessories and components required for their installation, connection and use.

Hexeli strives to present the products, their technical specifications and the included items as accurately as possible.

Slight differences may nevertheless appear between the photographs and the product received, in particular due to screen settings, shooting conditions or minor changes made to the product.

These differences must not affect the essential characteristics or normal use of the product.

Before placing any order, the Customer must consult the dimensions, power rating, electrical characteristics, technical specifications, installation conditions, included items and safety instructions stated on the relevant product page.

7. Installation and use of products

The lighting products sold by Hexeli must be installed and used in accordance with the instructions provided, the technical specifications stated on the product pages and the applicable regulations.

Before any installation, the Customer must in particular check the compatibility of the product with their space, their electrical installation and the intended use.

Any operation involving the mains electricity supply must be carried out in compliance with the applicable safety rules.

Where the nature of the installation, the skills required or regulations so require, the Customer must use a qualified professional.

Any modification of the product, wiring, connectors or power supply system not provided for in the manufacturer's instructions is likely to affect its operation and safety.

8. Prices and availability

The prices and conditions applicable to orders are detailed in the General Terms and Conditions of Sale.

Products are offered subject to availability.

Hexeli may change its catalog, prices and offers at any time. These changes do not apply to orders already confirmed.

The price invoiced is the price displayed at the time the order is confirmed, subject to the correction of any obvious error.

9. Orders

Any order placed on Hexeli.com implies acceptance of the General Terms and Conditions of Sale in force at the time of its confirmation.

Hexeli may refuse, suspend or cancel an order in particular in the event of:

  • reasonable suspicion of fraud;

  • a payment incident;

  • manifestly incorrect or incomplete information;

  • abusive use of a promotional offer;

  • a prior unresolved dispute;

  • exceptional unavailability of the product.

Where a payment has already been collected and the order is canceled, the refund is made in accordance with the General Terms and Conditions of Sale and the applicable legal provisions.

10. Payments

Payments are made using the payment solutions offered at checkout.

Transactions are secured by the payment providers used on the website. Hexeli does not directly store the Customer's complete banking details.

Use of a third-party payment service may also be subject to the terms of the provider concerned.

11. Delivery

Unless otherwise stated, orders are generally prepared and shipped within 1 to 2 business days.

The total delivery time is generally estimated at between 5 and 8 business days, depending on the product, destination and shipping method.

Some products, configurations or orders requiring special logistics may be subject to a different lead time. Where applicable, this information is communicated to the Customer.

12. Returns and refunds

Hexeli grants the consumer Customer a period of 30 days from receipt of their order to notify their intention to withdraw, subject to the applicable conditions and exceptions.

After this notification, the product must be returned in accordance with the terms and within the time limit set out in the Return and Refund Policy.

Except in the event of an error by Hexeli or a defect or non-conformity of the product, the direct cost of returning the goods remains the responsibility of the Customer.

The returned product must comply with the conditions set out in the Return and Refund Policy.

The detailed return conditions, any exclusions and the refund terms are specified in the General Terms and Conditions of Sale and the Return and Refund Policy.

13. Reviews and content submitted by users

Where a user voluntarily submits a review, photograph, video, comment or any other content, they warrant that they:

  • are authorized to submit this content;

  • do not infringe the rights of any third party;

  • do not publish unlawful, misleading, defamatory, abusive or discriminatory content;

  • do not submit personal data belonging to a third party without authorization.

Hexeli may moderate or remove any content that is manifestly unlawful, fraudulent, unrelated to the products or contrary to these terms.

Content moderation must not be used to mislead consumers about the authenticity or general content of published reviews.

14. Intellectual property

All elements accessible on Hexeli.com, including texts, photographs, videos, illustrations, logos, trademarks, product pages, graphic elements, tools, features, design and structure of the website, are protected by intellectual property rules.

Any reproduction, representation, adaptation, modification, extraction, distribution or exploitation, in whole or in part, without the prior written authorization of OZALO is prohibited.

Use of the website does not confer on the user any ownership rights over its content.

Trademarks, trade names, logos and content belonging to third parties remain the property of their respective owners.

Hexeli.com may contain links to or provide access to services offered by third-party providers, in particular payment, delivery tracking, customer review or social media services.

These services may be subject to the terms of use and privacy policies of the providers concerned.

Hexeli has no control over the content or operation of third-party websites and cannot be held liable for damage resulting exclusively from their use.

16. Availability and security

Hexeli implements reasonable measures to ensure the availability and security of the website.

However, permanent availability that is completely free of errors, interruptions or vulnerabilities cannot be guaranteed.

The user must protect their devices, data and any login credentials against unauthorized access.

17. Liability

Hexeli is responsible for performing its obligations under the conditions provided for by applicable regulations.

However, Hexeli cannot be held liable for damage resulting exclusively from:

  • unauthorized modification of the product, its wiring or its components;

  • an incompatibility that the Customer could reasonably have identified from the technical specifications available before purchase;

  • failure to follow the safety instructions;

  • an interruption originating from the internet network or an independent third-party service;

  • or an event of force majeure.

Nothing in these terms limits the legal guarantees, liability that cannot legally be excluded or limited, or the mandatory rights granted to consumers.

The terms applicable to an order remain those accepted by the Customer at the time of its confirmation, subject to mandatory legal provisions.

20. Governing law

These Terms of Use are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal proceedings.

Consumers may also have recourse to the consumer mediator indicated in Hexeli's General Terms and Conditions of Sale and Legal Notice, where the legal conditions for recourse to mediation are met.
